Terms of Use (EULA)

1. Acknowledgment & Scope of License

This End User License Agreement ("EULA") is a legal agreement between you (the "End-User") and the Developer (Niall, "we", "us", or "our"). Apple Inc. ("Apple") is not a party to this EULA.

We grant you a non-transferable, non-exclusive license to use the Application on any Apple-branded products that you own or control, and as permitted by the Usage Rules set forth in the App Store Terms of Service. In the event of any conflict between the Apple Standard SLA and these Terms of Use, these Terms of Use shall prevail.

2. Maintenance & Support

The Developer is solely responsible for providing any maintenance and support services with respect to the Application, as specified in this EULA or under applicable law. You and the Developer acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Application.

3. Subscription & Billing Terms

This Application offers auto-renewing subscriptions via Apple's StoreKit 2 framework:

3.1 Payment & Billing

• Subscriptions are billed to your Apple ID / iTunes Account upon confirmation of purchase.
• Payment will be charged to your Apple ID account at the confirmation of purchase.
• The subscription automatically renews at the selected rate (Monthly or Yearly) unless auto-renew is turned off at least 24 hours before the end of the current billing cycle.

3.2 Free Trial

• 3 free trials per day.
• Any unused portion of the free trial will be forfeited when you purchase a subscription.
• You will not be charged during the free trial period.

3.3 Cancellation

• Users can manage and cancel subscriptions at any time through their App Store Account Settings after purchase.
• Cancellation takes effect at the end of the current billing cycle. No refunds will be provided for partial billing periods.

4. Warranty & Product Claims

The Developer is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Application.

The Developer, and not Apple, is responsible for addressing any claims of the End-User or any third party relating to the Application or the End-User’s possession and/or use of that Application, including, but not limited to: (i) product liability claims; (ii) any claim that the Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

5. Intellectual Property Rights

You and the Developer acknowledge that, in the event of any third-party claim that the Application or the End-User’s possession and use of that Application infringes that third party’s intellectual property rights, the Developer, and not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

6. Legal Compliance

By using the Application, you represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

7. Acceptable Use & Media Content Ownership

• Users retain 100% intellectual property ownership of any media processed by this Application. The Application acts solely as a local processing tool and does not claim any rights to your content.
• You may use this Application to process any media that you have the legal right to use.
• You agree not to use this Application to process illegal, harmful, or infringing content.
• The Application does not store, analyze, or transmit your content — it remains entirely on your device.

8. Third-Party Terms of Agreement

You must comply with applicable third-party terms of agreement when using the Application (e.g., your wireless data service agreement).

9. Third-Party Beneficiary (Apple)

You and the Developer acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.
